MARRIAGE IN MOROCCO

The Moroccan authorities will require a lot of documents from British Nationals and their Moroccan fiancés planning to marry in Morocco including two which can be obtained from the British Consulate. (See appendix A). If you are a British National planning to marry a Moroccan National under Moroccan law you will need to make a declaration of honour that you are free to marry, and obtain a certificate of no-objection from the British Consulate in Tangier to present to the Moroccan authorities. You will also need a Certificate of Nationality issued by the British Consulate which includes the statement that the United Kingdom does not issue identity cards.

In order to apply for a Certificate of No Objection, please present the following original documents at the Consulate:
·Your passport
·If you have been married before, your divorce decree absolute, or, if widowed, your late spouse’s death certificate
·Your Moroccan fiancé(e)’s passport (or if he/she does not have a passport, his/her Moroccan identity card and birth certificate in French (if in Arabic with a translation into English).
·If your fiancé(e) has been married before, his/her divorce certificate, or, if widowed, his/her late spouse’s death certificate.
·Either, a certificate of no impediment from your nearest UK Register office if you are resident in the UK; or, if you are resident in Morocco you & your fiancé (e) must each take an oath after each of you has been residing in the Tangier Consular District (Tangier, Tetouan, Mdiq-Fnideq, Chefchaouen and Larache) for at least 3 weeks. Then a notice of Marriage will be displayed at the consulate for 3weeks, and then we can issue the certificate of no-objection.

As of 1 April 2024 the fees for these services are :
·Fee 22: Notice of Marriage £59.00 payable in Dirhams: DH 1,005.00
·Fee 24: Certificate of No-Objection £59.00 payable in Dirhams : DH 1,005.00
·Fee 1(a): Certificate of nationality £34.00 payable in Dirhams : DH 580.00
·Fee 3(2): Swearing an Oath £50.00 payable in Dirhams: DH 850.00

·MARRIAGE IN MOROCCO—WHAT TO DO NEXT

1. The ‘Certificat de non-objection au mariage’, your declaration of honour, and your certificate of nationality should be taken to the Moroccan Ministry of Foreign Affairs Legalisation office in Tangier for the British Consul’s signature to be legalised. Take with you six (6) 20 DH fiscal stamps. The address is:

(IMMEUBLE WAFABANK), 1ER ETAGE,
IDRISSIA,
TANGER.

2.After legalisation has been completed, you should take the papers to the Family Court in the district where you live if you are resident in Morocco. If you are non-resident you should take it to the Family Court where your fiancé(e) lives. These courts (Tribunaux de la Famille) have recently opened since the introduction of the new Code de la Famille (Family Law).

Take with you two 20 DH fiscal stamps. The Judge will ask you to provide the following documents :

APPENDIX A :LIST OF DOCUMENTS FOR MIXED MARRIAGES

1.For British men: A certified copy of your certificate of conversion to Islam, or a document proving that you were born Muslim.
For British women: Any of the following:
For Christians: a baptismal certificate
For Jewish women: a document showing you are Jewish
For Muslim women: a certificate of conversion or a document showing you were born Muslim.
2.If you are under 18 years old : written permission from your legal guardians (normally mother and father) for you to marry.
3.A certified copy of your marriage certificate and divorce decree absolute if you have been married before.
4.Certified copies of your, and your fiancé’s birth certificates.
5.A certificate of no-objection issued by the British Consulate and certified by the Ministry of Foreign Affairs office (Bureau des Légalisations du Ministère Des Affaires Etrangères located at 44, avenue Tarik Ibnou Ziad, (Immeuble Wafabank), 1er étage, Drissia, Tangier)
6.A letter addressed to the judge saying that you both wish to be married, with your personal details (including UK address), and passport details, and your Moroccan fiancé’s personal and identity card details. This letter must be written in Arabic.
7.A certificate of nationality issued by the British Consulate in Morocco
8.A police record issued by the local police in the UK for UK residents and by the Moroccan police for residents in Morocco
9.A record of no previous conviction for non-Moroccans issued by the Ministry of Justice, Rabat
10.A document proving your occupation and income
11.A certified copy of a valid identity card and a certificate of residency for those residing in Morocco or in a country other than their country of origin
12.A copy of the passport and a copy of the page showing the date of entry into Morocco
13.A medical certificate for each fiancé
14.A certificate of celibacy for the Moroccan person
15.A certificate of residency for the Moroccan
16.5 photos for the British person and 1 photo for the Moroccan

After you have married, and obtained your marriage certificate, if you and your spouse wish to live in the United Kingdom, your spouse must apply for a settlement visa. Marriage does not necessarily entitle you to a settlement visa.
